Definition

A DMCA Takedown (Digital Millennium Copyright Act takedown) is a formal notice submitted to an online platform requesting the removal of content that allegedly infringes on the submitter's copyright. Under the DMCA's safe harbor provisions, platforms like YouTube, Instagram, and TikTok must act on valid takedown notices to avoid liability. The process involves the rights holder submitting a takedown notice, the platform removing the content, and the uploader having the option to file a counter-notification if they believe the claim is invalid. Abuse of the DMCA takedown process — filing false claims — is illegal and can result in legal liability.
