Definition

Trade Dress refers to the visual appearance and overall commercial image of a product or brand — including color schemes, packaging design, layout, and stylistic elements — that identifies the source of the product to consumers. In the creator economy, trade dress can apply to a channel's distinctive thumbnail style, color palette, intro animation, or overall visual branding. If another creator deliberately copies these distinctive visual elements to confuse audiences, it may constitute trade dress infringement. Trade dress protection falls under trademark law and requires the elements to be distinctive and non-functional.
